RESPECTFULLY SHEWETH:
1. That through the instant application, the applicant/defendant humbly seeks    for setting aside ex-parte ORDER dated …………… (Now case is fixed for today …………………………………………….)
2. That the non-appearance of the applicant as a result of which ex-parte order dated ……………………………… was announced, was neither deliberate nor intentional, therefore, the applicant humbly seeks for setting aside ex-parte  ORDER dated …………………………….., inter-alia on the following:

1. That the applicant did not appear in the court nor he remained in contact with his counsel due to his swear illness. That the applicant is still under treatment (copies of prescription etc. is attached)

2. That the ex-parte order dated……………………………. is due to non-appearance in court and no service was made to the defendant to get an ex parte order by concealing the actual situation.
a) That the minor Jannat Bibi daughter of the applicant/defendant and the minor Fatima (daughter of the plaintiff from her Ex-husband is living with the applicant/defendant, photos are attached)   but the plaintiff is claiming maintenance by concealing the real facts.
b)   Respondent defrauded this Learned Court by withholding the truth, therefore, the ex-parte order dated …………………… is not sustainable in eyes of law and liable to be set aside, even whole suit is not maintainable but liable to dismiss.
c). That the applicant humbly seeks permission of this Learned Court for raising additional grounds at the stage of arguments, if needed.

P R A Y E R:
      it's humbly prayed that application in hand may kindly be accepted and order of ex parte proceeding kindly withdrawn by the opportunity to the defendant/applicant to reply/contest the case in the interest of justice and fair play.
