Amendment in Defamation Law 2021

The National Assembly Standing Committee on Interior has affirmed a bill to make alterations to the Pakistan Penal Code and Code of Criminal Procedure 1898 to make a move against the individuals who purposefully/intentionally defame/disparage the military.

The bill, named Criminal Law Amendment Bill 2020 presented by PTI MNA Amjid Ali Khan, was endorsed by the NA panel on the inside, which met here on Wednesday with MNA Raja Khurram Nawaz in the seat. 

The change, which will be called Section 500-A states: "Discipline for purposeful scorning of the Armed Forces and so forth Whosoever purposefully scorns, brings into notoriety or maligns the Armed Forces of Pakistan or a part thereof, he will be liable of an offense culpable with detainment for a term which may reach out to two years, or fine which may stretch out to 500,000 rupees, or with both."

پی ٹی آئی کے ایم این اے امجد علی خان کی جانب سے پیش کردہ فوجداری قانون میں ترمیمی بل 2020 کے نام سے بل کی این اے پینل نے اندر سے توثیق کی تھی ، جس کی نشست پر ایم این اے راجہ خرم نواز سے بدھ کے روز یہاں ملاقات ہوئی۔

اس تبدیلی کو ، جسے دفعہ 500-A کہاجائے گا: "مسلح افواج کی بامقصد نشاندہی کرنے کے لئے نظم و ضبط او اس طرح جو بھی جان بوجھ کر طنز کرتا ہے ، وہ بدنامی میں آ جاتا ہے یا پاکستان کی مسلح افواج یا اس کے کسی حصے کو بدنام کرتا ہے ، وہ اس کا ذمہ دار ہوگا۔ ایک مدت کے لئے نظربندی کے ساتھ جرم ثابت ہوسکتا ہے جس کی مدت دو سال تک ہوسکتی ہے ، یا جرمانہ جو 500،000 روپے تک ہوسکتا ہے ، یا دونوں کے ساتھ۔ "

اس بل کی توثیق سے قبل ، بورڈ آف ٹرسٹی نے پاکستان پیپلز پارٹی کے منتظم آغا رفیع اللہ اور پاکستان مسلم لیگ نواز کے عہدیدار مریم اورنگزیب کی طرف سے ٹھوس مزاحمت دیکھی تھی ، اس کے باوجود پینل کے ڈائریکٹر نے اس کے حق میں فیصلہ آنے پر چار کے خلاف پانچ ووٹ لے کر منظور کیا تھا۔ .

ورکنگ پیپر نے کہا کہ اس معاملے کے بارے میں ردعمل ایسا ہی تھا ، جیسے ہی ہو ، قابل اطلاق شراکت داروں سے کسی بھی صورت میں متوقع ہے۔ اس نے کہا کہ کے پی ہوم آفس نے اس بل کو قبول نہیں کیا ہے جس میں یہ بیان کیا گیا ہے کہ اس کے اعلان سے موجودہ مقدس اور قانونی انتظامات میں جدوجہد ہوگی اور اس کے ساتھ ہونے والی زیادتی کو دور نہیں کیا جاسکتا۔ اس کے علاوہ ، خیبر پختونخواہ کی حکومت نے بھی اسی طرح سے منظور کرلیاکہ اس قانون کے تحت قانون کے دیگر ضروری دفاتر اور عوامی کام کی جگہوں سے علیحدگی اختیار کی جا. گی ، جو آئین کے انتظام کے منافی ہے۔
